The article addresses the relationship between MLAT (mutual legal assistance treaty), a mutual legal assistance treaty signed between two or more countries for the execution of investigative, criminal action and crime prevention tasks, as was done between Brazil and the United States in 1997 and promulgated by Decree 3,810, of May 2, 2001, and the Marco Civil da Internet, approved and sanctioned in 2014 (Law 12.964 / 14), which establishes that Brazilian law be applied to legal entities with headquarters abroad in actions of collection, storage, storage and treatment of records, personal data or communications by connection providers and internet applications, provided that it offers service to the Brazilian public or at least one member of the same economic group has its headquarters in Brazil.
